Keep to your obligations and you won\u2019t go far wrong. There are a couple of areas where there is the possibility of confusion, and legislation is always changing. This quick guide should help to clarify the current situation.<\/p>\n<h3><\/h3>\n<h3>Tenants\u2019 responsibilities<\/h3>\n<p>A lot of this is common sense, but some of it may surprise you. It\u2019s worth knowing that a landlord can take action to evict a tenant who doesn\u2019t comply.<\/p>\n<p>As a tenant you must:<\/p>\n<ul>\n<li>Give your landlord access to the property to inspect it or to make repairs. Your landlord must give you 24 hours\u2019 notice and arrange to call at a reasonable time of day. If it\u2019s an emergency, you should allow immediate access<\/li>\n<li>Take good care of the property. For example, if you\u2019re going away during cold weather, take precautions like shutting off the water supply. Or if you spot something like a broken gutter, let the landlord know so that he or she can carry out any repairs<\/li>\n<li>Pay for, or repair, any damage, other than normal wear and tear, caused by yourself, your family or your friends<\/li>\n<li>Pay the agreed rent \u2013 even if you\u2019re in dispute with your landlord<\/li>\n<li>Pay other charges detailed in your tenancy agreement, such as utility and council tax bills.<\/li>\n<\/ul>\n<p>You must not sublet a property unless the tenancy agreement allows it.<\/p>\n<p>Finally, there are special circumstances when the landlord lives outside the UK. There is more information on this on the Government&#8217;s website at GOV.UK<\/p>\n<p>Landlords\u2019 responsibilities<br \/>\nNot surprisingly, the list here is longer. And as legislation never stays the same, it might well become longer still. At present a landlord must:<\/p>\n<ul>\n<li>Ensure that the property is safe and in good condition\n<ul>\n<li>Gas appliances must be installed and inspected annually by a Gas Safe registered engineer<\/li>\n<li>Electrical equipment must be properly installed and maintained.<\/li>\n<\/ul>\n<\/li>\n<li>Follow fire safety regulations\n<ul>\n<li>Smoke and carbon monoxide alarms must be installed and tested<\/li>\n<li>There must be accessible escape routes in case of fire<\/li>\n<li>Use fire-safe furnishings wherever furnishings are supplied by the landlord.<\/li>\n<\/ul>\n<\/li>\n<li>Protect any <a href=\"http:\/\/bit.ly\/2dOBT3U\">deposit<\/a>\u00a0in a government-approved scheme<\/li>\n<li>Check that the tenant has a <a href=\"http:\/\/bit.ly\/2e71MMA\">right to rent<\/a><\/li>\n<li>Give the tenant the following information:\n<ul>\n<li>An Energy Performance Certificate for the property<\/li>\n<li>Their full name and address or those of the letting agent<\/li>\n<li>A copy of the <a href=\"https:\/\/www.gov.uk\/government\/publications\/how-to-rent\">How to rent<\/a> checklist.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Landlords are normally responsible for repairs to:<\/p>\n<ul>\n<li>The structure of the property<\/li>\n<li>Sanitary ware, drains, interior and exterior pipes<\/li>\n<li>Heating and hot water systems<\/li>\n<li>Wiring<\/li>\n<li>Flues<\/li>\n<li>Any of the tenant\u2019s property damaged when carrying out repairs to the landlord\u2019s property.<\/li>\n<\/ul>\n<p>Tenants have a right to ask for repairs to be carried out, and where there are hazards, can ask the council to take action.<\/p>\n<h3><\/h3>\n<h3>Grey areas?<\/h3>\n<p>Sometimes it\u2019s not too clear who is responsible.<\/p>\n<p>For example:<\/p>\n<ul>\n<li>In a house divided into several flats, one tenant\u2019s flat may be damaged by another tenant<\/li>\n<li>An infestation of pests that could be the result of a long-standing problem or due to a tenant\u2019s poor hygiene standards.<\/li>\n<\/ul>\n<p>In cases like these, a bit of advice might be helpful.
